Expert’s evidence

Re M (Children), CA, 22 November 2007

Where an expert who had given his evidence in the form of a written report had not been required by either party to give oral evidence at the hearing, both parties were effectively bound by the statements of facts and opinion contained in that report. It was not open to them to raise issues on appeal that could have been raised in the course of the hearing.
