Aldi Stores Ltd v WSP Group plc and Others CA TLR 4 December; LSG 13 December

The appeal concerned an attempt to strike out a claim for abuse of process on the ground that the claims could and should have been brought in previous litigation, and the application of the principles in Johnson v Gore-Wood ([2002] 2 AC 1) to that attempt. It arose in complex commercial litigation about damage sustained to a retail store site.
