Cantor Gaming Ltd v Gameaccount Global Ltd [2007] EWHC 1914 ChD 25 September

This was the hearing to determine liability for costs following the substantive hearing in the action ([2007] EWHC 1914 (ChD)). The defendant admitted a minor breach of the claimant’s copyright in its computer software and had given undertakings to cease using it immediately. Nevertheless the claimant commenced proceedings for a comprehensive injunction. After the exchange of witness statements, attempts were made to settle the dispute and it was agreed that by the time of the trial, the defendant had ceased all alleged infringements. Nevertheless, the claimants were entitled to the injunction sought and applied for its costs in full.
