Standing arrangement and the indemnity principle

Ilangaratne v British Medical Association [2007] EWHC 920 (Ch)

The claimant had been the unsuccessful litigant in a negligence action against the defendant. The defendant had defended the claim through insurers who had instructed solicitors and the claimant alleged that there was therefore no retainer between the defendant and the solicitors, which was a breach of the indemnity principle.
