William Jaffray and others v Society of Lloyd’s [2007] EWCA Civ 586; SJ 29 June
Although the court had found that Lloyd’s had made untrue representations about its system of auditing and ability to make
reasonable estimates of the outstanding liabilities of syndicates, it had not been proved that it did not believe the representations
to be true or that it had been reckless. Therefore, the claims were dismissed. The claimant sought to reopen the appeal on
the basis that further evidence had come to light, which showed that the judge, and therefore the Court of Appeal, had been
misled by perjured evidence.
