Dayman v Canyon Holdings Ltd ChD LTL 11 January

The claimant trustee’s predecessor had obtained an order setting aside a property transfer made by a bankrupt to the respondent company. The claimant had issued proceedings to set aside a different property transfer in which he applied for the disclosure of documents which it was anticipated would reveal how the bankrupt had funded his defence in the other proceedings. The registrar refused the application on the basis that the order sought was akin to one for specific disclosure and such an order could only be made after standard disclosure, which had yet to take place.
