Hotel’s duty of care
Lewis v Six Continents plc CA TLR 20 January
The 27-year-old claimant inexplicably fell out of his hotel bedroom window on the second floor during the night. He claimed
damages under s2 of the Occupiers Liability Act 1957, alleging that the hotel had failed in its duty to take reasonable care.
He contended that the window should have been protected by bars, or by blocks or limiters on the sash window to restrict its
opening.
