Effect of offer to settle

Farag v Commissioner of Police of the Metropolis CA SJ 27 January

In a claim for damages for wrongful arrest, false imprisonment, malfeasance in public office and for assaults, the defendant had made an offer to settle the matter in 1997 at a stage when minimal costs had been incurred. The offer was withdrawn two years before the trial. Damages were awarded for one of the assaults and the rest of the claims failed. The defendant was ordered to pay the whole of the claimant’s costs on the standard basis. He appealed.
