Part 20 claims renamed

As it was one of the aims of the CPR to replace legal jargon with plain English, it was difficult to understand why the self-explanatory ‘counterclaim’ was replaced with ‘Part 20 Claim’. From 6 April, after a mere six years of inelegance, ‘counterclaim’ is to be restored by the Civil Procedure Rules (Amendment No 4) Rules 2005 (SI 2005 No 3515). By a further enlightened amendment additional, claims against another person seeking a contribution or indemnity are to be called ‘ additional claims’. The whole of Part 20 is replaced.
