Premature proceedings

Reid v The Capita Group plc ChD LTL 17 October

In a dispute over the value of shares, the defendant company was asked to provide a large number of documents. It supplied all but those that it claimed were not relevant. In response to the claimant’s threat to seek injunctive relief unless further documents were disclosed, the company said that it was cooperating fully and if an application was issued it required full notice. Proceedings were issued without further communication, further documents were supplied, although some were redacted, and then the proceedings were discontinued. The claimant contended that it had been necessary to issue the proceedings to obtain the documents sought and therefore claimed his costs.
