In its report
Improved Access to Justice – Funding Options and Proportionate Costs, The Civil Justice Council observed that although the proportionality and funding problems identified in our jurisdiction
(England and Wales) possess idiosyncratic features accruing from the history of our civil costs system and the special complexity
of recoverability of costs as part of an already complex system of conditional fees, at an early stage in its programme of
work on civil costs it appreciated that it should study how other jurisdictions around the world are currently addressing
the issues of funding and the costs of access to justice in civil cases.
