Unreasonable behaviour

Lifeline Gloves Ltd v Richardson and another [2005] EWHC 1524 (ChD)

The defendants successfully opposed the claimant’s application for summary judgment with the costs being reserved. The defendants then withdrew their defence. The claimant was awarded its costs on the indemnity basis on the grounds that the defendants’ conduct and the lack of merit in their defence amounted to unreasonable behaviour under CPR rule 44.3(4)(a) justifying an award of indemnity costs.
