Antisocial behaviour

Clingham v Kensington and Chelsea LBC (H of L TLR 21 October)

Proceedings for an antisocial behaviour order are civil in character and consequently hearsay evidence is admissible, however, the court has to be satisfied to the criminal standard of proof that it is appropriate to make such an order. Hearsay evidence, depending on its logical probativeness, is quite capable of satisfying the requirements of s1 (1) of the Crime and Disorder Act 1998.
