Interviewing single joint expert

Peet v Mid-Kent Healthcare NHS Trust ([2002] 3 All ER 688)

For the purposes of the assessment of damages awarded to a child born with cerebral palsy the court made an order for the joint instruction of seven non-medical experts to deal with different issues in relation to quantum. The claimant’s parents and their lawyers wished to have a conference with each of the joint experts in the absence of the trust’s representatives so that they could discuss the experts’ evidence and test its strength. They appealed the order of the master that no such conference should take place without the trust’s written consent.
