Wasted costs orders against counsel

Medcalf v Mardell ([2002] 3 All ER 721 H of L)

Jurisdiction

The wording of s51 of the Supreme Court Act 1981 does not mean that a party may not seek a wasted costs order against any legal representative other than his own. The wording of subsection 13 is simply intended to make it plain that no liability can attach to any practitioner not involved in the litigation giving rise to the claim.
