Varying a Mesher Order

Elliott v Elliott (CA CLW 6 April)

In ancillary relief proceedings the husband was given a charge of 45 per cent of the equity in the wife’s new home to be redeemed when the youngest child reached the age of 18 or completed full time tertiary education. He appealed against a variation of the order deleting his 45 per cent entitlement of the equity with a compensatory deletion of a nominal periodical payments order for the wife.
