Security Against Alien

Nasser v United Bank of Kuwait (CA 11 April unreported)

The provision in CPR 25.15(1) enabling the court to make an order for security for costs of an appeal in respect of parties outside the jurisdiction of the Brussels and Lugano Conventions is not discriminatory under the Human Rights Act 1998 Schedule 1 Part I Article 14, because the court retains a discretion and there is no assumption that such a party should be ordered to provide security as a matter of course.
