Glencot Development and Design Co Ltd v Ben Barrett & Son (Contractors) Ltd (T & C Ct, unreported 13 February)

The claimants’ application for summary judgment to enforce the decision of an adjudicator was opposed by the defendant on the grounds that the decision was unenforceable because the adjudicator had also acted as a mediator in settlement negotiations prior to the decision, a fact which the defendant maintained vitiated the adjudicator’s decision on grounds of bias.
