Disputing Quantum After Judgment

Pugh v Cantor Fitzgerald International (CA, Solicitors Journal 13 April pLB83)

In a claim against his former employer for wrongful dismissal the claimant obtained judgment in default of defence. The defence application to set aside the judgment was dismissed. In a counter-schedule the defendant repeated the allegation, first raised in his proposed defence, that the claimant had been guilty of gross misconduct disentitling him to damages and had failed to mitigate his loss.
