Insurance Premiums and Success Fees

Callery v Gray

The battle lines are drawn. Should after-the-event insurance policies be taken out as soon as possible, or only after it is clear that liability or quantum is disputed? What is the minimum success fee under a CFA? Although negotiations are continuing at every level, the Norwich Union are taking Callery v Gray to the Court of Appeal. The hearing date has not yet been set, and in the meantime hundreds of defendants are declining to pay insurance premiums in respect of claims which were settled without proceedings.
