Partnership Not Liable for Court Assault

Flynn v Robin Thompson & Partners (a Firm) and another (CA TLR 14 March)

An assault alleged to have been carried out in the court precincts on an opponent by a partner in a firm of solicitors, if proved as alleged, was so extraordinarily and so far removed from the ordinary conduct of an advocate or anything done with the authority of co-partners as to fall outside ‘the ordinary course of business’ within s10 of the Partnership Act 1890.
