Exemption and Remission

Application may be made retrospectively for exemption and remission of fees under all the fees orders save that in cases of financial hardship in probate the application can be for (discretionary) remission only. Where, not later than six months after paying a fee, the party who paid it applies for exemption or remission, this may be granted if it would have been granted had application been made at the time when the fee was paid. The period of six months may be extended if there is good reason for the application being made after six months. A fee paid before or after 25 April 2000 may be refunded in whole or in part as a consequence of this change.
