Costs of Claim and Counterclaim

Universal Cycles plc v Grangebriar Ltd (CA Lawtel 8 February)

The judge had awarded the claimant £109,000 on its claim for the balance owing for bicycles sold and delivered to the defendant and £25,000 for the defendant on its counterclaim for defects in the bicycles. The judge ordered the defendant to pay the claimant’s costs incurred prior to service of the defence and counterclaim but ordered the claimant to pay the defendant’s costs since that date.
