No Credit for Interest on Interim Payments

Parry v North West Surrey Health Authority (QBD TLR 5 January)

The claimant had received three interim payments from the defendant totalling £950,000 prior to the assessment of damages. The defendant contended that in calculating the final sum by way of damages interest earned on the interim payments should be deducted from the total amount of interest payable to the claimant on special and general damages.
