Scope of cover

Coromin Ltd v AXA Re [2007] EWHC 2818 (Comm), is a lengthy judgment of Mr Justice Cooke which largely turns on its facts and on the specific wording used by the parties. The key issue of wider significance is whether a business interruption policy that provides for an indemnity period running from the date of the insured peril, during which business interruption losses are incurred, is restricted to businesses being operated during the currency of the cover or whether it extends to new businesses that are developed later but are interrupted within the indemnity period.
