Charterers unable to load cargo in Turkey in consequence of outbreak of Gulf War - Whether charterers entitled to rely on “force majeure” exception

The vessel Orduna was chartered on the A.S.B.A. II charterparty for the carriage of crude oil from one or two safe ports East Mediterranean intention Ceyhan. On 30 July 1990 the charterers issued orders to the owners directing the vessel to proceed to Ceyhan to load min/max 750,000 barrels of Basrah Light Crude Oil, and then to proceed to Big Stone anchorage for lightering, thereafter to Philadelphia for discharge.
