Whether owners or charterers liable to pay surcharge incurred by reason of vessel exceeding safety draft on completion of loading cargo

The vessel Ermis was chartered under a Mediterranean C-Ore-7 voyage charterparty for the carriage of a part cargo of 5,400 tonnes of bauxite in bulk from one safe berth Xingang to the Mississippi. The charter provided for Customary Quick Despatch loading terms, and the freight terms were “FIO Spout Trimmed”.
