Service out of jurisdiction - Proceedings in tort based on alleged negligent survey - Whether damage suffered wholly or partly in Australia - Forum non conveniens

The plaintiff invoked the Admiralty jurisdiction of the Federal Court claiming damages for breach of contract and/or duty in and about the manner in which the defendant, S.G.S. Supervision Services Inc., carried out a survey of holds of the vessel Moon Valley, which had carried the plaintiff’s cargo of urea and other products from Canada to Australia.
