Bangladesh Admiralty jurisidiction - Whether based on English Admiralty Courts Act 1861 or Administration of Justice Act 1956

The plaintiff lighter-owner, upon filing an Admiralty suit for recovery of lighterage hire for carrying cargo from outer anchorage to destination, filed an application for the arrest of the vessel Kapitan Lukhmanov as security for its claim. The second defendant, i.e. the vessel, caused appearance and contested the arrest contending that neither the suit nor the application was maintainable in the Admiralty jurisdiction of the High Court Division of the Supreme Court of Bangladesh which was exercised under the Admiralty Court Act 1861.
