Demurrage - Whether charterers liable to pay demurrage for time lost at a result of vessel’s slow pumping rate

The vessel Bow Princess was chartered on the Asbatankvoy form dated 14 November 1990 for the carriage of a part cargo of 28,500 tonnes clean condensate from one safe port Algeria to one or two safe ports Caribbean range. The vessel was described as having “cargo tanks stainless steel/Epoxy/Zinc coated”. Her previous three cargoes had been chemicals. At the time of negotiations the charterers were aware that the vessel was not a crude oil tanker, but rather a chemical carrier. The vessel was chartered to cover a position as the vessel which the charterers had originally chartered was unable to perform her fixture.
