Enforcement of foreign arbitration awards in Canada - Whether Canadian statute unconstitutional - Limitation period

The United Nations Foreign Arbitral Awards Convention Act 1986 (“the Act”) brought into force the provisions of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958. By subsection 4(2) of the Act, the Convention was to apply to “arbitral awards and arbitration agreements whether made before or after the coming into force of this Act”.
