Attorney General of the Republic of Ghana and another v. Texaco Overseas Tankship Ltd. (The Texaco Melbourne) - Q.B.D. (Com.Ct.) (Webster J.) - 7 November 1991
Whether statutory interest on damages should be reduced by reason of plaintiffs’ delay in prosecuting proceedings
The plaintiffs had obtained judgment for damages against the defendant. Issues arose as to the plaintiffs’ entitlement to
interest, and these were put over to a separate hearing. At the adjourned hearing the defendant contended that the plaintiffs
were guilty of unjustified delay in prosecuting the action, and that therefore they should not be entitled to statutory interest
for the full period.
