Shipowners liable to cargo receivers for cargo shortage - Charterers did not appoint tallymen until after part of the cargo had been discharged - Whether charterers liable to indemnify shipowners for failure to appoint tallymen earlier

Bills of lading stated that a total of 180,000 bags of sugar had been loaded onto the vessel. When the cargo was discharged, the receivers, relying on tallies which they had arranged to have carried out, claimed that only 177,923 bags had been discharged, and they advanced a shortage claim for the difference between the bill of lading quantity and the number discharged according to their tallies.
