Industrie Chimiche Italia Centrale and Another v. Alexander Tsavliris & Sons Maritime Co. and Others (The Choko Star) - Court of Appeal (Slade, Parker and Glidewell L.JJ.) - 16 March 1990
Salvage - Whether shipowners and master have ostensible authority to enter into salvage contracts on behalf of cargo owners
Salvage services were rendered to the vessel
Choko Star
under a Lloyd’s Standard Form signed by the master of the
Choko Star
purportedly acting on behalf of the owners of the vessel and her cargo. The plaintiffs were the owners of cargo on board the
vessel at the relevant time. They contended that the master had no authority to engage the salvors on their behalf, and that
they were not liable to contribute to the salvage remuneration.
