Package limitation - Whether limit is £100 or equivalent gold value

The issue in this case concerned the construction of Article IV, rule 5 of the 1924 Hague Rules. The Article provided that unless the nature and value of the goods had been declared before shipment and inserted in the bill of lading, the carrier would not be liable for loss or damage “in an amount exceeding £100 per package or unit.” Article IX provided: “The monetary units mentioned in this Convention are to be taken to be of gold value.”
