Home and Overseas Insurance Co. Ltd. v. Mentor Insurance Co. (U.K.) Ltd. - Q.B.D. (Com.Ct.) (Hirst J.) - 28 July 1988

Court will not give summary judgment on construction of contract where Arbitration clause requires that any dispute should be decided by arbitrators in accordance with the spirit rather than the letter of the agreement

The plaintiffs were insurers and re-insurers. The defendants carried on a similar business until 23 August 1985 when they went into voluntary liquidation.
