Seashell Shipping Corporation v. Mutualidad de Seguros del Instituto Nacional de Industria - Court of Appeal (May, Parker and Stocker L.JJ.) - 27 July 1988

Writ - Whether service out of jurisdiction appropriate - Proper law of contract

The plaintiff was a Panamanian corporation and the defendant was a Spanish insurance company. The defendant applied under Order 12, rule 8 to set aside the writ and its service out of the jurisdiction. Leggatt J. granted the defendant’s application. The plaintiff appealed to the Court of Appeal.
