Collision action - Judge’s apportionment of liability upheld

On 16 January 1979 the plaintiffs’ ship Rimac was in collision with the defendants’ dumb barge BGL-2 in the river Schelde a little to the west of Flushing. The barge was in the control of the tug Ouro Fino . At the time of the action Sheen J. held that both parties were to blame and apportioned liability 40% on Rimac and 60% on Ouro Fino - [1986] 2 Lloyd’s Rep. 466.
