Mount Royal/Walsh Inc. v. The Ship Jensen Star - Fed.Ct. (Trial Div.) (Martin J.) - 17 February 1988

Shiprepairer’s in rem claim survives transfer of vessel’s ownership where vessel immediately demise-chartered back to original owner

The plaintiff supplied material, repair services and equipment to the vessel Jensen Star. At the time the materials and services were provided the beneficial owner of the ship was Jensen Shipping Ltd. The plaintiff brought in personam claims against Jensen Shipping Ltd. for $291,243, of which $264,036 was claimed in rem against the Jensen Star .
