Whether shipbrokers entitled to compensation after sale falls through because vessel not ready for delivery

Mr. Yamvrais, a director of the plaintiff company, was a London shipbroker. He negotiated the sale of the vessel Manifest Lipcowy by the defendants to a company to be nominated by a Mr. Kafalas. The sale and purchase contract was based on the Norwegian Sale form. It called for delivery during May/June 1982, with 30 June 1982 the cancelling date in buyers’ option. In the event, the vessel was not ready for delivery on or before 30 June 1982 and the buyers cancelled on 1 July.
