Whether lessor of containers entitled to maritime lien on vessels in respect of charges incurred when containers not on board

Plaintiff Flexi-Van Leasing Inc. leased marine cargo containers and chassis to defendant Atlanttrafik Express Service Ltd. (“AES”). Rent for the containers and chassis, together with other charges, remained unpaid by AES. The plaintiffs asserted an in rem lien in respect of damages represented by the outstanding amounts against the former vessels of AES, which had gone into liquidation.
