Naviera Mogor S.A. v. Société Metallurgique de Normandie (The Nogar Marin) - Q.B.D. (Com.Ct.) (Staughton J.) - 11 December 1986

Whether master’s negligence prevents shipowners recovering from charterers under indemnity

The vessel Nogar Marin was chartered to carry a cargo of wire rods from Caen to Tampa. The cargo was manufactured and supplied by the charterers. On discharge at Tampa the wire rods were found to be rusty. The cargo receivers arrested the vessel. The shipowners compromised the action. The bills of lading had stated that the goods were shipped in apparent good condition.
