Service of writ out of jurisdiction - Alternative forum’s non-recognition of insurance law allows plaintiffs to sue in England

The plaintiffs sought leave to issue a writ against the defendants and to serve them out of the jurisdiction. The claim arose out of certain reinsurance contracts. Leave was given ex parte , but the defendants subsequently successfully obtained a stay of the English proceedings conditional upon the Saudi Arabian Courts assuming jurisdiction. The plaintiffs appealed to the Court of Appeal.
