The Silver Athens (1986 Action) - Q.B.D. (Adm.Ct.) (Sheen J.) - 22 May 1986

Admiralty action stayed and arrest set aside in 1984 - Whether second action can be brought in order to arrest vessel in 1986

In March 1984 the plaintiff time-charterers issued a writ in rem against the vessel Silver Athens claiming damages or an indemnity in respect of any sum the charterers might have to pay to the owners of cargo. The plaintiffs applied for and obtained a warrant of arrest for Silver Athens , and the ship was arrested at Immingham a few days later. The plaintiffs’ purpose was solely to obtain security for any award in their favour in an arbitration which had been commenced some two months earlier.
