Edmunds v. Adas - (Court of Appeal) - 10 February 1986

The Court of Appeal has confirmed that when, after issue of a writ claiming damages and interest, the defendant tendered the full amount of the sums claimed without interest, the plaintiff was still entitled to summary judgment for the amounts claimed with interest and the court would then take account of the fact that there had been a payment and acceptance on account of an amount equal to the full amount of the damages when it made its order.
