Tug and tow - Allocation of responsibility for delay and for damage to tow

The plaintiffs (“Goliath”) were disponent owners of the tug Salviva who were contracted by the defendants (“the APA”) to tow a floating crane, the Montaser , from Japan to the Port of Alexandria. The form of written contract agreed between the parties contained, inter alia , the following clauses:
