Locabail International Finance Limited v. Agroexport (The Sea Hawk) - 18 December 1985
The Court of Appeal has affirmed the principle that an English Court should be reluctant to grant an interlocutory mandatory
injunction against a foreign defendant without representatives or assets in England. The Court of Appeal allowed an appeal
by the defendants from such a mandatory order requiring them to pay a sum of money to the plaintiffs under the terms of a
contract. The English Court would have been powerless to enforce its order.
