Bills of lading falsely dated by shipowners’ agents - Whether shipowners liable as principals

By a contract dated 29 April 1982 on the GAFTA form between the plaintiffs as buyers and Tracomin S.A. of Lausanne as sellers, Tracomin undertook to sell to the plaintiffs 4,500 tons of Ricebran extractions, 5% more or less at sellers option, for the price of $118 per metric tonne in bulk, cost, freight and insurance to Garston U.K. free out. Clause 6 of the agreement provided:
