1. Scope of the chapter
A detailed treatment of the law of trusts is beyond the scope of this book and reference should be made to the standard textbooks on trusts for a full explanation of trustees’ powers, duties and liabilities. 1 This chapter deals with the liabilities to which professional trustees are subject by reason of their professional status and is concerned with professional trustees who have been expressly appointed, as opposed to constructive trustees.
