“Procedural mishap” in the course of arbitration - Whether award should be remitted to arbitrator

A dispute arose out of a charterparty dated February 1981 made in Piraeus between the applicants as charterers and the respondents as owners. It concerned remittances allegedly made by the applicants to the respondents. Submissions were made by both sides to the arbitrator. In late March 1985 he observed in a telex sent to both parties’ solicitors that there was no proof of payments made by the applicants to the respondents and invited the applicants to provide such proof if they wished to.
